Unmitigated? If I take in the article's complaint properly, then here's a double down (somewhat insane from a Westerner's point of view) argument for mitigation over litigation, if and when your 'Fortunately' argument fails (these are trying times afterall and for myriad peoples).

Maxim - Globalites don't get a hall pass from at least one nation's civics. Further, it is in the interest of humanity itself to protect the undergird of world commerce from MF Global's kind of flippancy regards the hard beneficial work of others (participants) toward the betterment of trade. This protection is likely a punative affair. Unfortunately, and passing over a well greased and established groove, some people insist on behavior, which forces profits to lurch toward settlements via a now necessary presiding body.

More to the point, at this time any decadence directly impugning the tested global commercial infrastructure underpinning itself leads to loss of profit in the form of unpredictability regards the business capacity and temperament of the new fiefs, tolls, and trolls. Everyone knows this. Make example of these MF Global clowns and so all who cherish their kind of business. Today, when there is so much talent literally rotting on the sidelines, the idea that some particular big shot needs to be rescued from error, recycled back into the game, or can grace his or her way back to professional favor is fucking absurd.

Sirs, prior to MF Global's debacle, you never had to deal with any of these fiends (at this level or over this mechanism). Their absence thus marks ease that is progress. It tells of a hard earned and well established, greased groove regards commerce, one worth fighting for to sustain. Famed the world over, in English it's called trust.
