ENGLEWOOD CLIFFS, N.J. (AP) -- Plaintiffs who say they were excluded from settlement talks on an electronics company's plans for a corporate tower in northern New Jersey are arguing against the project in a state appeals court.
Lawyers for Carol Jacoby and Marcia Davis told a three-judge panel Monday that Englewood Cliffs illegally rezoned a property for the proposed $300 million LG Electronics USA headquarters.
They say the borough should've conducted a master plan study and held public hearings on the plan to build a 143-foot tower in an area where building height is capped at 35 feet.
The appeal went on despite an agreement between LG and conservation groups to reduce the plans to a five-story north wing just shy of 70 feet tall and a three-story south wing.
Conservationists agreed to withdraw their appeal of zoning variances.
