TORONTO, ONTARIO--(Marketwire
- March 11, 2011) - Energy Fuels Inc. (TSX:EFR) ("Energy
Fuels" or the "Company"), an advanced uranium and
vanadium development company, earlier announced that Sheep Mountain
Alliance based in Telluride, Colorado had filed suit in District Court,
City and County of Denver, Colorado, naming the Colorado Department of
Public Health and Environment (CDPHE) as Defendant.
On February 23, 2011, CDPHE filed a Motion to Dismiss Sheep Mountain
Alliance's lawsuit (Sheep Mountain Alliance vs. CDPHE) which challenged
CDPHE's license approval granted on January 5, to Energy Fuels
Resources to construct and operate the Pinon
Ridge uranium mill near Naturita, Colorado.
In its Motion, CDPHE argues that the Denver District Court does not
have jurisdiction to grant Sheep Mountain relief, and that Sheep
Mountain lacks standing to sue the State regarding this license
decision.
Yesterday, Energy Fuels filed its own Motion to Dismiss Sheep Mountain
Alliance's lawsuit. Energy Fuels' Motion joins in the arguments
presented in CDPHE's Motion. It also specifically asks the Court to
dismiss Sheep Mountain's First Claim for Relief, which alleges that
CDPHE issued Energy Fuels' radioactive materials license without
conducting the necessary administrative procedures. Energy Fuels'
Motion to Dismiss argues that Sheep Mountain's interpretation of the
applicable statutes, as set forth in its First Claim for Relief, is
legally incorrect, and that, as a result, the Court must dismiss that
claim.
